EMERGENCY:
The first 60 minutes after an accident
EmergencyThe first 60 minutes
Call 911
Call 911 immediately, even if the crash seems minor. Request police so the scene is documented and injuries are addressed. A police report creates an official record that can protect you later.
Take Photos
Use your phone to capture everything—vehicle damage, license plates, road conditions, skid marks, traffic signs, and visible injuries. Take wide shots and close-ups. You only get one chance to preserve the scene.
Spot Witnesses
Look around for anyone who saw what happened. Independent witnesses can make or break a disputed case. Get their names and contact information before they leave.
Statements
If witnesses are willing, ask them briefly what they saw and record it on your phone. Keep it simple and factual. Early statements are powerful before memories fade.
Hospital Care
If you feel immediate pain or anything unusual, get checked immediately. Adrenaline masks injuries. However, beware of sky-high medical bills from local hospitals. Try to use health insurance to cut down the medical costs.

HOW TO HANDLE:
Your property damage claim
PropertyTotal loss or repair
Total Loss
When your car is not fixable
The Insurance Company will appraise your vehicle based on fair market value (not blue book), sometimes in person, other times just pictures. The price is based on the price of comparable vehicles being sold in your area.
If you owe money on your vehicle (lien), the insurance company will pay the lien holder(s) first and the remaining amount goes to you.
You are entitled to a rental vehicle for a short duration (as little as 48 hours after your vehicle is declared a total loss). So if your vehicle is totaled—or you anticipate it will be—start looking for that new vehicle sooner rather than later. Any undue delay may cost you extra.
Repair
When your car is fixable
The Insurance Company will likely suggest one of their affiliated repair shops, but you have the right to go to any licensed body shop you choose. Choose wisely who fixes your vehicle.
The Insurance Company is required by law to pay for a rental vehicle for the duration that your vehicle is in the shop. Once it's ready, you'll need to return the rental—extra days could cost you extra money.
If your vehicle is newer and/or low mileage, you may be entitled to a diminished value settlement. This is the amount your car's value has gone down due to the accident.

HOW TO HANDLE:
Your injury claim
Injury ClaimHow we build it
Care
The therapy
Your health is the priority. Get medical treatment immediately and follow through with every appointment, referral, and therapy session. Be honest about your symptoms and consistent with care—gaps or delays can weaken your claim. Expect the insurance company to closely review your treatment history and question whether your injuries are related to the crash.
Records
The proof
Strong cases are built on strong documentation. Save every medical bill, prescription receipt, repair estimate, and work excuse. Track missed work, mileage to appointments, and how your injuries affect daily life. We gather medical records, crash reports, and proof of damages to clearly show the full impact of the accident.
Demand
The negotiations
When treatment stabilizes or you reach maximum recovery, we prepare a comprehensive demand package. It outlines fault, summarizes your medical care, and details your financial and personal losses. The insurance company will respond with questions or a counteroffer—then negotiation follows, and we stay aggressive and prepared to pursue the full value of your claim.
04
COMPENSATION:
How much is my case really worth?
CompensationThe math behind value
Economic Damages
Medical bills, wages, etc.
1Add total medical bills (ER + doctors + PT + meds + imaging + surgery). Use the statements, not guesses.
2Add future medical costs your doctor recommends (more PT, injections, surgery, follow-ups).
3Add lost income (days missed × your daily pay). Also include any PTO used.
4Add out-of-pocket costs (mileage, parking, medical equipment, help at home, child care).
+
General Damages
Pain & suffering, mental anguish, etc.
1Start with how serious the injury is (strain vs. herniation, etc.).
2Look at the treatment level (chiro/PT only vs. injections vs. surgery). More intensive treatment means higher value.
3Factor the timeline (weeks vs. months vs. long-term symptoms).
4Add the life impact (missed activities, trouble sleeping, pain with driving/lifting, limits at work/home).
5Include lasting issues (scars, permanent limits, loss of enjoyment).
=
Settlement Value
Settlement Economic + General damages
Then cross-check it with:
aFault — clear liability usually helps; disputed liability can reduce value.
bInsurance limits / coverage — can cap or limit the result.
cProof quality — consistent care + clean records + strong documentation usually increases value.
dCausation — issues with pre-existing conditions.

At the Law Office of Chip Forstall we work on a contingent contract, which means we do not charge anything up front and do not get paid unless & until you get a settlement. Our job is to take all the financial pressure off of you so you can focus on getting better.
It depends on how long treatment lasts and how serious the injury is, or other issues that prolong a case. Rushing usually helps the insurance company, not you. Our goal is to move it forward while still getting a fair result.
Whatever you have: crash report info, photos, insurance details, and any medical paperwork. If you don't have everything, don't stress—we can still start and help gather the rest.
You may still have options through your own policy, like uninsured/underinsured coverage. We'll check every possible coverage so you're not stuck holding the bag.
Be careful. Adjusters are trained to get statements that help the insurance company. It's usually best to keep it simple and let us handle the conversations so nothing gets twisted.
No. Insurance companies look for posts to minimize injuries, even innocent photos or "I'm fine" comments. The safest move is to stay quiet online until the case is over.
You may still have a case. Many claims involve shared fault, and you can often recover even if you were partially responsible. We'll break down the facts and tell you where you stand.
Deadlines can sneak up fast and missing one can kill a claim. The safest move is to talk to us ASAP so we can lock in the key dates, preserve evidence, and protect your rights. General Auto Injury cases now have a 2 year prescriptive date.
Sometimes bills still come in while the case is open. We help you understand your options and work to reduce the financial pressure while your case moves forward.
Most cases settle without ever seeing a courtroom—but we prepare every case as if it will. That readiness is exactly what pushes insurance companies to offer fair value. And if a fair settlement isn't on the table, we're fully prepared to take it to court and fight for you.
Yes. Many of our clients don't have health insurance when they're hurt, and we can connect you with trusted providers who will treat you now and wait to be paid out of your settlement. You get the care you need without paying upfront, so you can focus on healing while we handle the rest.
These cases often involve bigger insurance policies and more parties—an Uber or Lyft driver's coverage, a trucking company, or a commercial insurer. That can mean more value, but also more complexity and a more aggressive defense. We know how to track down every source of coverage and hold the right parties accountable, whether it's a rideshare, a delivery van, or an 18-wheeler.
Yes—Louisiana is unlike anywhere else, and it genuinely affects your case. We're the only civil-law state in the country: here you can often file directly against the at-fault driver's insurance company, and under our pure comparative fault rule you can still recover even if you were partly at fault (your award is reduced by your share). Filing deadlines—called "prescription"—are strict, and if you were driving uninsured, Louisiana's "No Pay, No Play" law can limit what you collect. Knowing the local parishes, courts, and insurers is a big part of getting it right.
Louisiana law sets a specific order. The right belongs first to the surviving spouse and children; if there are none, it passes to the surviving parents, then to surviving siblings, and then to surviving grandparents. Only the highest-ranking class can bring the claim. If you've lost a loved one and aren't sure where you stand, call us—we'll walk you through it with care.
They're two separate claims Louisiana lets the family pursue together. A wrongful death claim compensates the family for their own losses—loss of love and companionship, support, and funeral costs. A survival action recovers what your loved one experienced before passing, like their pain, suffering, and medical bills from the injury. We handle both, so nothing your family is owed gets left on the table.
